Terms & Conditions

PAYMENT TERMS:

Upon affixing their signature to this contract, the Host commits to adhere to the terms outlined herein at the mutually agreed-upon price specified on Page 1.

 

OUTSIDE FOOD:

Royal Albert Palace allows outside food from food providers upon approval. Please note that a deduction of $5.00 per person will be made from the agreed-upon per-person price.

 

CANCELLATION AND DATE CHANGE:

All amounts paid are NON-REFUNDABLE. If Host cancels or changes the date, the Host shall be liable for any monies due and owing.

In the event of cancellation or date change by the Host, and if Royal Albert Palace is unable to rent out the hall, Host will be responsible for a cancellation fee of 75% of the Hall Rental price.

 

PAYMENT DEFAULT:

In case of failure to make timely payment of cancellation charges, Host shall be responsible for all costs of collections, attorney fees, court costs, and an interest rate of 1.5% per month, commencing thirty days after the scheduled event or thirty days after the Host cancels or changes the event time, whichever is sooner.

INSURANCE:

Host shall provide and keep enforced during the event, with reputable insurance carriers, the following insurance:

  • Comprehensive General Liability insurance including blanket contractual liability endorsements and liquor liability with limits of at least $2,000,000.

  • Host must provide such other insurance as reasonably required by Royal Albert's Palace, Inc.

  • All insurance required shall be in form and issued by companies authorized to do business in the State of New Jersey.

The host shall deliver to Royal Albert's Palace, Inc. a Certificate of Insurance showing payment in full of the premiums.

The insurance policies shall provide written notice to Royal Albert's Palace, Inc. at least thirty days prior to any material change or cancellation.

If Host's insurance is not in compliance with the requirements as of ten days before the event, Royal Albert's Palace, Inc. may, at its discretion, obtain said insurance for Host, and Host shall reimburse for all fees and premiums.

 

LIABILITY AND INDEMNIFICATION:

Host hereby agrees to protect, indemnify, defend, and hold harmless Royal Albert's Palace, Inc., its shareholders, employees, agents, and assigns against any and all claims, losses or damages to persons or property, governmental charges or fines, and costs (including attorney fees), arising out of or connected in any way, shape or form with Host's event, whether within the prescribed use of the property or not. This indemnification shall extend to any claims or liabilities that may arise as a result of the Host's actions or omissions, even if such actions or omissions occur outside the agreed-upon use of the property.

PROPERTY RESPONSIBILITY:

Host is responsible for any damages to the facility caused by the Host or their guests. Costs for repairs will be charged to the Host. Royal Albert's Palace is not responsible for any items (including but not limited to merchandise, alcohol, equipment, clothing or other items) lost, left unattended or not removed after the scheduled event by Host, Guest or Third Party Vendor.

 

FORCE MAJEURE:

Royal Albert's Palace, Inc. is not liable for acts of God, disruptions of services, or events beyond its control. In such cases, events may be canceled or changed without liability.

 

SUPERVISION AND REFUSAL:

Royal Albert's Palace, Inc. reserves the right to supervise and direct facility use, and to refuse entry or eject guests deemed unfit, at its sole discretion. Further, any use of the facility in a manner it was not intended to be used as or shall cause interference with the use of another in any way shall impose additional expenses on the Host.

 

ADDITIONAL TERMS:

Entire Agreement: This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements or understandings, whether written or oral. Any amendments or changes to the within Contract must be made in writing, and signed by both parties.

  1. Governing Law and Venue: This Agreement shall be governed by and construed in accordance with the laws of the State of New Jersey. Any legal action shall be brought in the state or federal courts located within the State of New Jersey.

  2. Attorneys' Fees: The prevailing party in any legal action is entitled to recover reasonable attorneys' fees and costs.

  3. Waiver of Jury Trial: Both parties waive the right to a trial by jury in any legal action arising from or related to this Agreement.

  4. Responsibility: Royal Albert's Palace is not responsible for the conduct of Host, Guest or Third Parties hired to provide services.

  5. Assignability: The contract is not assignable or transferable without the written consent of Royal Albert's

Palace, Inc.

  1. Supervision of Facilities Use: Royal Albert's Palace, Inc. retains the right at all times to supervise and direct the use of its facilities. It reserves the right to refuse admission or eject any guests who are deemed unfit to enter or remain on the premises, as determined at Royal Albert's Palace, Inc.'s sole discretion.

  2. Cancellation for Breach: In the event the Host breaches this contract, Royal Albert's Palace, Inc. reserves the right to cancel this contract without liability.

  3. Royal Albert's Palace, Inc. bears no liability in the event that the Host encounters difficulties in obtaining a liquor license. In such circumstances, any consequences or ramifications related to the liquor license are solely the responsibility of the Host.

  4. Royal Albert's Palace, Inc. refrains from providing endorsements or recommendations for specific vendors.

It is explicitly the Host's responsibility to meticulously choose vendors according to their preferences, ensuring that selected vendors comply with the stipulations outlined in this Contract.





Vendor Insurance Requirements, Duties, & Limitations: Vendors engaged by the Host, such as DJs, photographers, and decorators, must furnish proof of liability insurance coverage of at least a mi on, with Royal Albert's Palace, Inc. named as an additional insured. This proof of insurance must be submitted at least 24 hours before the event (15 days for Decorators). Vendors are also expected to dress appropriately and conduct themselves properly, refraining from alcohol consumption; failure to comply may result in refusal of entry or ejection. The DJ and Photographer are required to promptly dismantle and remove their equipment immediately at the conclusion of the event, ensuring a swift and efficient post-event cleanup. Any meals, services, or incidentals provided to the Host's vendors or contractors will be charged to the Host as per this Agreement. Furthermore, any recommendations provided by Royal Albert's Palace are subject to independent scrutiny, and Royal Albert's

Palace bears no responsibility for any dissatisfaction with the services rendered

The Host, DJ, and/or Photographer are entrusted with the responsibility of utilizing 3M Gaffer #6910 tape

cables, and other equipment to the carpet floor during the event. Post-event, it is imperative that

The Host's vendors diligently clean up all tape residue. The Host will be held accountable for any damages caused by its vendors during the course of the event.

Under no circumstances does Royal Albert's Palace, Inc. permit the sale or exhibition of any merchandise without the acquisition of a license issued by the appropriate governmental authority, including a sales tax number.

The Host assumes full responsibility for all taxes associated with any such sale or exhibition, and compliance with these regulatory requirements is essential.

The Main Ballroom and Mandap Hall feature a decorative balcony without elevator access, and it is not handicapped accessible.

The Host acknowledges that Royal Albert's Palace, Inc. assumes no liability for any

losses or damages related to restricted access to the decorative balcony.

  1. The Host recognizes that Mera Gaon Hall lacks an elevator and is not handicapped accessible. Royal Albert's Palace, Inc. is not liable for any losses or damages arising from the limited accessibility of Mera Gaon Hall.

  2. Hosts claiming Non-Profit Organization status must provide a copy of the 501(C)(3) Approval Letter from the IRS to Royal Albert's Palace, Inc. Failure to do so prior to the event will render the Host responsible for any owed sales taxes

  3. Absolutely no Hip-Hop music is permitted; its inclusion will lead to immediate termination of the event by Royal Albert's Palace, Inc., resulting in the forfeiture of the deposit and associated fees.

 

The Host acknowledges that Indian food may contain nuts and is aware of the responsibility to inform Royal Albert's Palace in advance if there are individuals with food allergies in the party. The Host accepts that Royal Albert's Palace and its Management are not accountable for any issues related to food allergies.

The Host explicitly recognizes and agrees that Royal Albert's Palace, Inc., along with its shareholders, agents, and employees, shall not be held responsible for any loss, property damage, medical liability, worker's compensation claims, injuries to the Host, guests, or vendors arising from the actions or inactions of the Host. This includes losses incurred due to factors beyond the control of Royal Albert's Palace, Inc., such as power outages, inability to facilitate activities, epidemics, governmental regulations, or any other unforeseen events adversely affecting the event. The Host commits to indemnify and hold Royal Albert's Palace, Inc., its shareholders, employees, agents, and assigns harmless from any losses incurred by the company in any manner.
